I doubt there would have been any difference whatsoever no matter how I contacted them, the way they worded it is no ifs no buts, you're not allowed to distribute it.

Worded in much the same way as AP's clause for Wherry Lines then..........
You, me, anybody else not being able to distribute files doesn't rule out Creative themselves getting involved---admittedly a mine field if other commercial providers assets are involved.
Part of the reluctance of commercial developers to endorse *amateur* amendments is down to the question of support: we can't expect them to resolve any issues not caused by them. Add to that the potential for conflicting enhancements: improvement A + improvement B could easily = a non functioning route, even if singly A and B both work faultlessly.

Before the workshop came into existence, Dovetail Games, or Rail Simulator.com as it was, didn't allow mods of their routes to be uploaded anywhere without permission. Evidence of this is see how many modified commercial routes from pre-2013 do you see in the UKTS or any other file library?
Reskins of products like loco's are a different matter because you do actually need the original for it to work by excluding the shape file from the mod upload.
All this discussion took place on here 4 or 5 years ago and if I remember rightly, the answer from the powers that be was you could modify for your own personal use. If you wished to share with others, you could only upload files that were not part of the original route and that included the Tracks.bin file. Unless I'm pretty much mistaken, that is exactly the same as Creative Rail have stated.
As I said in my first reply in this thread. The Steam Workshop and the fact that people can freely edit routes from Steam in an enclosed and copyright controlled manner, has clouded many judgement when it come to commercial content outside of Steam.
For disclosure, I am affiliated with a third party developer however, I do not know anything about any future releases unless I'm working on them and even then, I'd be breaking years worth of built up trust to say anything about it

I sought RSC's permission to upload my GWR modification of their Falmouth Branch route here in early 2011, but as I recall there were a few modified routes uploaded before mine. RSC's guidance to me was that modified routes were acceptable provided that the download included only route content files, it required the original route DLC to operate, and their disclaimer was attached.Before the workshop came into existence, Dovetail Games, or Rail Simulator.com as it was, didn't allow mods of their routes to be uploaded anywhere without permission
