Usually you would be right, but I believe it is a condition of the UKTS freeware packs that modification of the content is permissible (though I stand ready to be corrected on that one too!)
In the case of the freeware packs I couldn't find a specific reference to reskins in

4.1 Licensing Conditions for Donated Content
To ensure that content remains permanently available to users once donated
contributors must agree to the following conditions:
Content may NOT be withdrawn from the pack after they have been
donated
All content may be used, distributed, re-skinned and re-packaged with
any freeware route or scenario.
I read that as a case of "it's allowable to re-work the assets in the freeware packs if you wish, and include them with a route or scenario you've created", but not a 'go ahead' to chop out a reskins features and add them to a different base model, certainly not without seeking permission from the original author before making any modifications available. I suppose this is a grey area, one that wasn't envisaged at the conception of the free packs.
I sincerely hope that David's generosity in allowing the original EWS class 66 re-skins he did to be re-released is not seen as a free-for-all on his other work.
Legal and IP issues aside, it's also just good old fashioned 'manners' to ask first!!
