I would hope that most freeware rolling stock authors will not object to use of their assets in payware scenarios, but I think it's right to ask permission first. Come to think of it, what is the situation regarding use of non-RSC payware rolling stock in payware scenarios?

Any additional stock has to be downloaded by the user.
Stock included/not included, that shouldn't make any difference as the product is making money from the use of that stock which is free. I am not saying that particular point is wrong in itself but it should be common courtesy to contact the creator of the relevant items, as is being done.

It is no different to me releasing a payware route, then stating that certain freeware items need to be downloaded to complement it. These items may well have a strict caveat not to be used in a payware route but by the above logic, if I didn't include them, whats the problem? It's a sticky subject to approach, we have already been there many times and will no doubt do so again.

Top and bottom is, if you are to release something as payware, be sure to have all ends covered as to avoid future embarrassment.

Its a tricky job trying to make money out of railworks users isn't it? why not just release them as freeware like others do, avoid the problems, keep the day job and enjoy the hobby. :)

I tend to agree with Pete's post, and he has mostly already written how I feel on this topic, but probably more eloquently then I could put it :).

Frankly, I am really not happy about this, and would not want any of my Freeware models being used in a commercial scenario.

To me it does seem a bit unethical and goes against, the whole "freeware" ethic in which I created the models in the first place.

It does look as if Freeware and Railworks do not make good bedfellows, and I really can't see me doing much more in that respect.

From what I remember that was written for me by someone in the legal profession (a Barrister, I think). In theory, it should cover most eventualities.
