Commercial Add-On Problems

Sorry if this story goes a long way around but here goes.
I am currently on buying several of the commercial MSTS add-ons.
Firstly I ordered East Coast Express Part 1 from a reputable Ebay dealer and when it arrived through the post it was part 2. Not a problem though because it can run independently.
Next, I ordered Great Eastern from the Making Track Ebay shop, it took a while to come but no problem.
Recently, I ordered part 1 again from the same place that I ordered it the first time, my partner informed me that it had arrived and I left instant feedback based on this. The product was sealed but on opening the case, it contained the booklet from Part 2 so the serial number wont work (obviously)
I sent an email to the seller but was bluntly informed that no action could be taken on their part because I had left feedback and the transaction was finished. I have subsequently been in touch with first class simulations and contact simulations but they wont help due to me purchasing the product through a third party provider.
If anybody has read this far I apologise for being long winded but I was wondering if anyone else has had similar problems.

Welcome to the forums.
The only problem with serial numbers I've had was where the number was too long, but a slip of paper was included which told you that.
I bought plenty of secondhand CDs off Ebay and they've been fine.
I would try the publishers again, you may have to return the whole product.

The fact that you've left feedback on Ebay does not remove your statutory rights - ultimately, the Sale of Goods Act says that the product has to be of merchandisable quality and do what it's supposed to. If you don't have the correct serial number due to a blunder by the seller, you can't install it, so it's defective, in the legal sense. You therefore have the legal right to get a replacement or refund.
I think I might have been wary of using this seller, given the fact that they sent you the wrong product first time around - you learn by your mistakes!

You may wish to consider buying your add-ons from UKTS - the prices are competitive and you get one month's free premium membership (giving fast, unlimited downloads from the library) for every order you make. Orders are shipped every Tuesday and Friday normally, so anything you order on a Thursday, for example, should get to you by the Saturday morning. You'd also be helping to support the community in the process.

Ditto what Ash says, can't speak highly enough of UKTS' CD distribution system.
You haven't lost your statatuory rights but unfortunately it's not clever to leave feedback prior to receiving the item.
First have a go at the publisher, and then if all else fails, try Ebay, and possibly, if you paid by PayPal or Credit Card, you could also get a refund off them I think.

I don't know how long it took for you to receive your goods but we aim to dispatch the next working day if the product is in stock and I hope that the delay in delivery does not perturb you from coming back to us again to purchase.

As has been said above, feedback is not the end of a transaction and should there be an issue, you are covered by your statutory rights and the Sale of Goods Act. (

Key Facts of the Sale of Goods Act wrote:• Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale).
• Goods are of satisfactory quality if they reach the standard that a reasonable person would regard as satisfactory, taking into account the price and any description.
• Aspects of quality include fitness for purpose, freedom from minor defects, appearance and finish, durability and safety.
• It is the seller, not the manufacturer, who is responsible if goods do not conform to contract.
• If goods do not conform to contract at the time of sale, purchasers can request their money back "within a reasonable time". (This is not defined and will depend on circumstances)
Q1. What is an inherent fault?
A fault present at the time of purchase. Examples are:
• an error in design so that a product is manufactured incorrectly
•
an error in manufacturing where a faulty component was inserted.
The "fault" may not become apparent immediately but it was there at the time of sale and so the product was not of satisfactory standard.
Note that it states it is the Seller not the Manufacturer so technically, Contact Sales are not obligated to provide any support if the product was pre-opened and contained the wrong manual. If the seller is not happy to deal with this issue, I would recommend contacting eBay directly about this matter.
While Making Tracks (and indeed UKTS) do not offer the most competitive prices for MSTS Add-Ons, you are sure that when purchasing via one of these channels that you are buying from reputable vendors and that any profit is being put back into MSTS Development (be in in the Freeware community or by direct support of a developer). You also have the added bonus when buying from UKTS of the free months premium to download any upgrades and extra activities and stock that the community have created.

Cheers for all the input guys, will look into it further rather than sit with an expensive coaster.
As for buying from UKTS, I would love to do this as well as pay for premium access but my only current payment method is paypal and I have seen the messages and opinions on this issue so I wont go there.

Then again, if this could be arranged just for me then I would also be eternally grateful.
