This isn't a forum, it's a thread.
Sorry to be pedantic.

No worries Muz, i've gotten used to it ;)

Anyway, ideaswise, your limited to whats been done in the books and the TV show. Hopefully not being offensive, but spending time making pointless threads would actually be better spent making the models your after ;)

Hmmm I dont want to kick up old problems, but be VERY careful in the making of TTTE models. Remember people own the copyrights on them.. people with lots of money and good solicitors.. :(

Dont get me wrong, im not scaremongering, nor am I disuading you from filling a large gap in the MSTS market... Just ask yourself this:

In a 4 year old game, why has no one else made one of the most iconic fleets of railway engines in history? Then read the first paragraph again. :)

Are we talking about reskining here???

Cause if we are, I've got one, I can't remember the diesels name, but it was an Orange 0-4-0 narrow gauge diesel, it used to work the P-way trains on that narrow gauge route that looks as if it's set in Wales :-?

Anyway, how about reskining the Talyllyn MERSYSIDER into that unique livery

Oh god...here we go.

You'd have thought that they'd be sicking the dogs on us by now. They didn't then and I don't think they will (unless we start selling the models for profit). It's such a great way of scaring people out of making good models. :-?

Moderators Note:
Im not trying to do that all, I just want to make new people aware of the potential implications of what they are doing. The official line (just checked in the mods forum) is that uploads are still permitted, and in fact we never banned them, however it was decided when this was debated last time that should there be a change of policy they will be removed without warning.

Thats Rusty, based on TR No.5 Midlander. No.8 is a different shape, however some of the freelance style NG diesels around might be a bit more sutiable?

Sorry Pitley, I didn't mean to sound like I was ripping on you
I'm just still irritable of all that hubub that was raised a few years ago from all this. However...I definately respect the mods/admins decision on this :)

And thus we return you to your regularly scheduled topic ;)

Cheers Evan,

No hassle intended, and dont mean to come across as the fun police on this one. Just want people to realise the potential implications of what they are proposing.

Here is a couple of suggestions!

1. Diesel 10(Class 42 Warship)
2. D199(Class 46)
3. Daisy(Class 121)

Those are a good Idea, someone is making the Sodor Route, as I have visited their website.

I think what some members here sometimes fail to understand is that just because the owners of the Thomas copyrights have not done anything about models in MSTS to date does not mean they are not going to and do not have the right to at some later date. They may simply feel it's not something worth pursuing at present. However if someone started selling a Thomas route for commercial profit then I think things would happen.

However comments such as 'if they were going to do somthing about it then they would have by now' are simply not a sensible apprecation of the situation.

It the copyright owners did decide to take action I expect the very first thing they would require is for all models to be removed from here (and other sites possibly) discussion of Thomas related models to cease and all models on users home PCs destroyed. In such a situation the copyright owners may use legal force to shut down UKTS until all Thoimas related content had been removed from their servers.

I just need to let you all know that this IS a very sersiuous situation and if UKTS gets shut down (even temporarily) then it would have ben because of your actions and attitudes. It is probably very much for the best if Thomas related issues are discussed in private and not on UKTS.

I'm not saying all that as a moderator or from a UKTS standpoint, it's my personal view but do think it is a realistic scenario.

Hi Martin

Well said and your comments are "Spot On"

I was involved with Copywrite Legal Action before I retired and I can assure all the Forum readers that just because no action has been taken so far that definitely does not mean that action in the future will not be taken even if it is or was issued as Freeware.

Please believe what Martin is saying and do what he suggests as I for one would not like any risk whatsoever of UKTS being temporarily shut down.

Kindest Regards

Mike

I've always thought TTTE would make a good subject for MSTS. The pop-up messages could tell a story.

A route hasn't appeared in four years and there's little practical use for the loco's until it has. We're all enthusiastic but the enthusiasm for TTTE is unbridled and I've always considered that's at the root of of any concern.

The chances of freeware passed around in the normal fashion being a problem must be very low. However there was talk of payware which caused alarm. Doubt there's any modellers who don't appreciate TTTE fans desire to have their favourite characters in MSTS form. However the zeal with which these models are sought appears to override possible practical problems.

There's also the matter of respect for an author's wishes. Most will give permission if they feel they're dealing with people who're prepared to share the responsibilities which do exist. They're usually adults to whom the Law can applied unlike most of those who want the models.

Years ago, I read 'John Dibben's Warship could be Diesel 10' as if I have little to do with it. Accepting is having your arm twisted but refusing has you down as a spoilsport. That's 'Trick or Treat' applied to trainsimming authors.

I'm confident a more relaxed attitude and a route of some kind would see the permissions for reskinning models being forthcoming in most cases without any problem.

As always, it comes down to seeing some input other than 'face painting' to make it appear credible.

Trainz has TTTE models but again no layout.

Reckon an 'official TTTE' included in a new sim would be a huge selling point. There's potential but it has to channeled in a manner which gains the confidence of those who're going to build anything associated with it. That done, who knows what could be achieved.

We've little right to model anything and distribute it where money is involved. We do it in a 'grey area' using common sense to interpret the Law.

The vast majority of the time all we do is copy someone else's idea. Much maligned MS has allowed us great freedom. That can't be taken for granted with the new sims. No one usually takes on MS but copyright infringements by a smaller company would be more of a gamble. We will be 'allowed' to create models and cannot 'expect' permission for anything. That's something we'll all have to abide by and a subject yet to be addressed but one I'd keep in mind if wanting to continue in the manner we have been allowed to by MS and Auran.

This subject comes up time and time again.

It will only achieve results when everyone acts calmly, appreciates each other's point of view and accepts there are responsibilities in life which mean we can't do as we like with what should always be remembered, is someone else's property.
