Bang goes my DVD

Just went to use RS and now i find the DVD has cracked in the centre. So thats me stopped for the time being! Has anyone else had this problem or am I just lucky? After all the care taken with it! Why does it need to be running anyway? Really fed up coz I am no longer able to couple up in MSTS so the shunting I was enjoying in RS can no longer be done in the "Old" sim.

Oh well its Great Eastern time again.

I would suggest you contact EA to see if you can get a replacement disk .

Just return it to where you bought it, they should give you a new replacement copy.

If you bought it in the last 28 days, that is.

Best bet is to contact EA, in the book.

To be entitled to a replacement within a reasonable period up to 6 years you have to prove that the product is faulty.
The product is the software that is installed from the DVD not the DVD its self. The DVD is nothing more than a distribution method.

Not sure where you've heard that from.

Check out page 15 of the booklet. The limited warranty is 3 months from the date of purchase, after that it's £7.50 per disc.

The DVD is also the product as without the distribution medium, the software is useless to the customer. In the eyes of the law, you are buying both, so your normal consumer rights apply to both.

The magic words are 'fit for purpose'. If the DVD cannot stand up to being used all the time, but you have to have the DVD in use to play the game, then it is a simple matter to prove that the product, as sold, is not fit for purpose. The trading standards people should support you. Then, if enough people do this, EA may have to rethink its copy protection methods.

Good advice - refer to page 15 of the manual for full details of the media warranty.

I believed that law, can be limited to say, 3 months (the booklet) or 28 days (most receipts), if the company who issues the product says that they will only offer a replacement up to that date.

In which case, 3 months would be the limit for a free replacement.

With products like washing machines or televisions, I would expect the returns policy to last longer.

Which magazine always says that goods should be fit for purpose and should give a reasonable life span. Time limits by the manufacturers are not binding if the goods have not been abused or broken intentionally. You should expect a good few years out of a game like Rail Simulator and as it only came out in October I cannot see how anyone can say that 3 months is a reasonable time for the game to last. Your DVD if it has had nornal use was faulty. The shop, the people responsible in law, or EA should provide a replacement IMHI.
I had many problems with my first Sky+ box. I wrote to Sky when my 12 month guarantee was due to run out to warn them that the box had not been satisfactory. When it again failed several weeks later I had to pay to get them to come out to it but they later refunded my costs.
Don't be put off by these people they are happy to sell you extended guarantees which 9 time out of 10 are just ripping you off as if a product lets you down in the first 3 years of it's life it was not fit for purpose and should be replaced by the selling agent.

EA could easily turn round and claim it was the DVD ROM or improper use which broke it. It's slightly different to a Sky+ Box which you just turn on and use. A DVD requires to be physically removed from a box and placed into a drive, which then uses a laser to read it. A Sky+ Box you push the on button, then use the remote - minimum contact.

Sorry folks, posted a reply yesterday but dont know where it went, so in case it doesnt appear I'll say again that the disc split in the middle both sides of the hole. I had used it earlier and to save "over handling" it I left it in the DVD drive. So it was not pushing it on to the cases fixing point that caused it. I was worried about leaving it in the drive but was told many people leave them in there for months if you are going to be using it a lot. You may tell me I am wrong but I still think it silly we have to use the original DVD just to use the sim. Yes I tried to copy it but it does not accept it as the original. Pity.
