Due to a recent copyright claim I have had to remove a video called "Railworks 3 Class 37 super thrash" from Youtube, as it apparentley contained a song called "bajo la luna" owned by palapa records, even though there was no music In the video. The only thing in the video was the class 37 locomotive (Settle & Carlisle EWS version)

None of this content was owned by palapa records.

Does anyone know why they have claimed a video that doesn't have anything to do with them?

There has been a lot of that lately on youtube, I had a copyright claim on some music that I had written and performed myself, it didn't resemble anything else close enough to be mistaken for it, there is an appeal process if you want to go through it, some websites claim that it is a scam, with the scammers claiming copyright to videos, then making money from the ads attached to the videos.

Darn scammers!

Instead of saying "Darn scammers!", appeal the decision. Their are other video hosting sites.

Wouldn't other video sites work in the same way and have people doing the same there?

And how do you know other video hosting sites don't have better measures in attempt to avoid what you stated?

False assertion of copyright is probably breach of copyright in itself. Definitely appeal this one. PM me for free legal advice

Thanks for the advice, if it happens again I'll try to appeal the claim, but at the moment I thought of making another video showing a wider variety of 37's Including the AP 37/9's when I get them running again.

Could I ask why you didn't use the contact us or equivalent (cough UR cough) on Youtube to solve your problem in the first place?

I didn't think there is one on youtube.

YouTube does have a process for appealing an incorrect Content ID match. Go into your Video Manager page, click on the "matched third-party content" link next to the video in question. You'll get this page where you can disagree with the match using the link at the bottom...



Follow through the process, I can state from personal experience that it does work. Don't sweat on it either, when you have automated content matching systems you are bound to get false positives every now and then.

I had an incident where an unknown music composition group claimed copyright on one of my railway videos. The funny thing was, there was no music whatsoever in the video that cropped up in the content ID matches . So without any hesitation, I filed a counter-claim and the debate got overturned with full rights handed back to me. My advice to anyone in this situation is. If you made the video (lets say lineside railway filming from a public park) and as long as no third party content has been used (audio/visual). The video is yours and you own the copyright to that video. So I would say, file a counter-claim. I've done it before and I have no problem in doing it again.

However in regards to video games. I would be careful when making videos of gameplay as I have seem numerous videos of gameplay videos get pulled and in some cases, channels have been closed down. While I have not seen this problem occur so much for train and flight simulations. Its been more common with certain popular carjacking games which have commercial music in them. I won't say the exact name of the game developer or title, but for those that can put 2 and 2 together and come up with 4 will know the answer.

I would file a counter-notification in this situation and claim your video back. As there is no music in the video in question. Its probably just a false-positive match and YouTube will need to be made aware of this. You won't receive any copyright strikes on your account in this situation.

Having video's on YouTube of games would probably act as promoting them and addons for games like railworks as it generates interest so people are more likely to buy the game/addon itself, that's why I usualy state the addons I use in railworks videos.
